The CEO may request intervention of the relevant Minister, member of the Executive Council or member of the Municipal Council, if necessary. Where the CEO fails to act in accordance with the findings and recommendations of the ombud, the ombud may request the intervention of the Minister. After an investigation, the ombud is required to inform the complainant and/or respondent of the findings and recommendations. The expenses of the ombud are paid from the budget appropriated for the office by Parliament. The clause makes provision for the ombud to act impartially and independently, in good faith and without prejudice, fear or favour. The Minister, the national department and office must afford the ombud such assistance and support as may be reasonably necessary for the ombud to perform the expected functions effectively and efficiently. The ombud must prepare a report for the Minister on the affairs and functioning of the ombud and submit it to the CEO for inclusion in the report of the Office of Health Standards Compliance.
