10. The Committee takes a dim view of the statements - threats even - from certain (not all) quarters of the magistracy to embark on a course of illegal industrial action. This cannot be supported. No matter the level of frustration, it is unacceptable that the public be disproportionately prejudiced in this way. The Committee draws attention to the words of Chaskalson CJ in the van Rooyen judgement quoted above. Further, the Committee is of the view that magistrates should know the importance of following due process.
