South Africa has one of the most progressive and transformative property clauses of any constitution in the world. It provides explicitly for appropriation at fair and just compensation and goes so far as to put a positive obligation upon the state to take reasonable steps to ensure citizens have access to land. The Constitution also makes it clear that no provision may impede the state from taking legislative and other measures to achieve land, water and related reform in order to redress the result of past racial discrimination ...
