The Intellectual Property Laws Amendment Bill of 2010 was referred back to this House by the President. The Bill was referred to the Portfolio Committee on Trade and Industry in March 2013. At issue were two matters: The classification of the Bill as a Money Bill and classification as a Section 76 Bill. This, because of certain provisions that affect matters listed in Schedule 4 of the Constitution. The committee deliberated on these matters and reports as follows:
The committee agreed with the President's view that the Bill is not a Money Bill, so that issue was dealt with.
The second issue was that the committee, as advised by the Joint Tagging Mechanism of Parliament, agreed that the Bill did indeed deal with matters listed in Schedule 4 of the Constitution and should be retagged as a Section 76 Bill.
