On the commissions of inquiry where Legal Aid SA is mandated and funded by the establishing authority of the commissions, legal aid will be provided for the purposes of legal representation of witnesses or persons appearing before a commission of inquiry where the commission has certified that they have standing before such a commission. The position in respect of providing legal aid in extradition matters has also been clarified because persons facing extradition hearings risk the possibility of facing substantial injustice if unrepresented because such persons may lack the ability to place evidence before the court that the alleged charge does not warrant a prosecution in a foreign court.
