Whether commercial companies that mine sand must comply with the conditions
of the Land Use Planning Ordinance Amendment Act, Act 64 of 1992; if not,
why not; if so, what are the relevant details? NW2901E
REPLY
The Minerals and Petroleum Resources Development Act, 2002 (Act 28 of 2002)
is the statutory instrument passed by Parliament (the National Assembly and
the National Council of Provinces) to regulate the minerals and mining
sector in South Africa. There is no provision in the Minerals and Petroleum
Resources Development Act, 2002 which stipulates that decision taken in
terms of this Act are subject to provisions of a local government.[pic]
