16. There is currently a ban on children under 14 awaiting trial in prison. While recognizing the challenges, the Committee has decided to provide for this restriction to be extended to children under 14 being sentenced to a term of imprisonment. Unlike other provisions of the Bill, there was not substantial consensus within the Committee on whether the exclusion should apply to the child when he or she is under 14 at the time of sentencing, as the Bill provides for, or whether the child has to be under 14 at the time of the commission of the offence. This may require further consideration in future.
