(1) Whether her department developed and adopted a policy providing
guidelines for the appointment of persons with a criminal record; if
so, (a) when was the policy (i) developed and (ii) adopted and (b)
where can a copy of the policy be obtained; if not,
(2) whether her department has any plans in place to develop and adopt
such a policy; if not, why not; if so, what are the relevant details;
(3) whether her department does any pre-employment screening of potential
employees for criminal records; if not, why not; if so, what are the
relevant details;
(4) whether any employees with criminal records are currently employed by
her department; if so, (a) how many and (b) what is their (i) job
level and (ii) occupational category? NW1991E
REPLY
(1)(a)(i)(ii) The Department of Correctional Servicesâ Post
Advertisement and Recruitment Policy was formally approved and
implemented as from 15 October 2003. The Department also provides
guidelines for the appointment of persons with a criminal record
within the Departmental A-Order. In terms of this policy
candidates are informed when applying for a post that reference
checking will take place. Candidates with criminal records must
state the nature of the criminal offence. No person can be
appointed with criminal record unless the offence has been
disclosed and subsequently condoned by the National Commissioner.
The nature of the offence and incarceration must not compromise
the department and be in contradiction with the relevant functions
of the post and day to day operations of the Department. The
Department is in a process of reviewing and realigning all
policies including this policy. A reviewed policy will be
presented to the Minister for approval in 2010.
(b) A copy of the policy can be obtained from the Office of the
Commissioner: Cape Town.
(2) Please refer to the answer in (1)(a) above.
(3) Yes, the Department does pre-employment screening of potential
employees in line with the Minister of the Department of Public
Service and Administrationâs directive according to Public Service
Regulation 2001, Chapter 1, part VII D.8(a). This deals with the
verification of a candidateâs information prior to appointment or
filling of a post. The directive took effect on 1 January 2008 in
all Government Departments.
Personal Suitability Checks are conducted on all recommended
candidates prior to appointment and the verification comprises of
the following: Criminal Record checks, previous employment
verifications in terms of reference checks, Qualification/study
verification, Financial/asset record checks; and, Citizenship
verification.
Any negative information (such as Criminal records) received back
from NIA, will be documented and forwarded to the Commissioner for
consideration and condonation.
(4) The officials employed in the Department with criminal offences
are from salary level 3 up to salary level 15 and also covers
across the spectrum of the different Occupational Classes of
Correctional Services.
The total employed with criminal records according to the
different Regions is indicated hereunder.
