âMrs E C van Lingen (DA- EC) to ask the Minister of Arts and Culture:
1) Whether her department has conducted a research into the impact the
development of Nuclear 1 will have upon the Khoisan cultural heritage
along the coast from the Klasies River (caves and mummy) to the Gamtoos
River; if not, why not; if so, what measures is her department taking
to protect the Khoisan heritage on the Thyspunt site;
2) Whether her department has submitted any documentation on the
Environmental Impact Assessment (EIA) Reports for Nuclear 1; if not,
what is the position in this regard; if so, what are the relevant
details?
REPLY:
1. The developer (ESKOM) submitted a development plan in a form of a
scoping report to the National Department of Environmental Affairs and
the South African Heritage Resources Agency (SAHRA). This process
regulates and determines the sensitivity of the development area;
whether a record of decision or permit will be issued. Based on the
sensitivity of the area, public participation is called on to
determine, whether the development will go ahead or not.
The provisions of the National Heritage Resources Act (No 25 of 1999)
and the new Regulations of National Environmental Management Act (NEMA)
clearly stipulate the management of any development in the country. In
terms of the National Heritage Resources Act (NHRA), the impact
(positive or negative) is identified at the scoping period. The
developer is mandated to conduct the heritage impact assessment. The
Heritage Impact Assessment (HIA) of this development has been submitted
but not approved due to the sensitive nature of this site.
As indicated above the HIA is not approved by SAHRA so the development
will not proceed. The KhoiSan Heritage Route and the Sarah Bartmann
Projects are attempting to address these concerns; conservation of
Khoisan Heritage in the region. The processes of identifying and
preserving KhoiSan heritage are taking the forms of the Sarah Bartmann
Project and the KhoiSan Heritage Route. The Sarah Bartmann Centre of
Remembrance will not only provide an Interpretative space in memory of
the life of Sarah Bartmann but will serve as a repository of the
material of on intangible heritage of the Khoi and the San communities.
The KhoiSan Heritage Route is aimed at preserving the heritage of the
Khoi and the San people of South Africa. Sites have been identified
throughout the nine provinces, and from these identified sites the
beneficiaries will decide which sites will be developed and promoted.
The concept of the KhoiSan heritage route will broaden beyond site
development and will include various elements pertaining to KhoiSan
heritage (tangible and intangible); indigenous knowledge systems,
language and culture. Both projects are national heritage projects and
will preserve KhoiSan History on a national scale.
2. The new NEMA Regulations (Regulation Gazette NO. 9314, volume 540, 18
June 2010, no. 33306) provide three listing of notices activities in
terms of section 24D (1)(a) of the National Environmental Management
Act. Further more, the third listing identifies sensitive areas/sites
such as Thyspunt. In this case, the record of decision (RoD) will not
be issued by the Department of Water Environment on the sensitive
areas; they will consult with competent authority such as SAHRA in
order to make recommendations.
The Public participation with KhoiSan clearly rejected the idea of
the project. The details and comments from SAHRA were submitted to the
Environment Company Arcus-Gibb. The details of the EIA are submitted to
the Department of Environment at the end of the process.
