REQUEST FOR THE COMMITEE TO INVITE THE WESTERN CAPE MINISTER FOR SOCIAL DEVELOPMENT TO ACCOUNT FOR THE ARBITRARY, UNJUST AND UNLAWFUL REMOVAL OF MY CHILDREN FROM THEIR PARENTAL CARE AND PROTECTION

Dear Portfolio Committee on Social Development,

Be pleased to take note that I, Bathandwa Arries, residing at Thembalethu, George, Western Cape shall on this 11th April 2023 submit the above mentioned request to the attention of the portfolio Commitee on social Development for attention and for appropriate remedial action to be taken by Parliament.

BACKGROUND OF THIS REQUEST:

On 1st November 2019, the George Child and Family Welfare Social Worker, Mrs/Mrs Kleynhans removed my two minor children from their parental care and placed them in temporary safe care without a court order without there being any justifiable reason to do so, except only that the children were in the ambit of Section 150 of the Children's Act no 38 0f 2005 as amended.

On 11 August 2020 I wrote to the W.C. Provincial Dept. of Social Development requesting the Department to investigate allegations of power abuse against the GCFW Social Worker.

On 17 November 2020 I was served with the findings of the Department in which the Department did not agree that the alleged Social Worker had abused her powers.

I wrote on many occassions to the Department objecting to its findings on the basis of the legal provisions of the Children's Act.

I have never received any correspondence regarding this matter even from the Minister of Social Development in the W.C and it is on this basis that I request the intervention of the Commitee concerned
