NCOP rushes to pass 15 bills; only three sent back to NA

The National Council of Provinces (NCOP) passed fifteen bills in just two days this week (26 and 27 March), in a rush before the close of Parliament’s last session. Twelve of the bills were sent to the President for assent. Minor amendments were made to only three bills by the NCOP.

These were the three bills that had minor changes (which will need to go to the NA for consensus):

Rental Housing Amendment Bill [B56B-2013]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape and North West voted in favour of the Bill, while the Western Cape voted against it.

The Bill has been referred back to the NA for concurrence after proposed amendments from the NCOP.

Women Empowerment and Gender Equality Bill [B50B-2013]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape, and North West voted in favour of the Bill, while the Western Cape voted against it.

The Bill has been sent back to the National Assembly due to proposed technical amendments from the NCOP. It was also proposed that amendments should be dealt with after the elections.

Financial Management of Parliament Amendment Bill [B1B-2014]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape, and North West voted in favour of the Bill. The Western cape voted against the Bill.

Minor amendments were made by the NCOP and the Bill has been sent back to the NA for concurrence in accordance with section 65 of the Constitution.

The rest of the bills were passed without amendments:

Infrastructure Development Bill [B49B-2013]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape, and the North West voted in favour of the Bill. The Western Cape voted against it. The Bill was sent to the President for assent.

State Attorney Amendment Bill [B52B – 2013]:

All nine provinces voted in favour of the Bill. It has been sent to the President for assent.

Determination of Remuneration of Office-Bearers of Independent Constitutional Institutions Laws Amendment Bill [B 31B – 2013]:

The NCOP passed the Bill and it has been sent to the President for assent.

Restitution of Land Rights Amendment Bill [B35-2013]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape and North West voted in favour of the Bill, while the Western Cape voted against it. It has been sent to the President for assent.

National Environmental Management Laws Third Amendment Bill [B26B-2013]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape and North West voted in favour of the Bill, while the Western Cape voted against it. The Bill has been sent to the President for assent.

Environmental Management: Waste Amendment Bill [B32B-2013]:

The Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape and North West voted in favour of the Bill. The Western Cape voted against it. The Bill has been sent to the President for assent.

National Environmental Management: Protected Areas Amendment Bill [B 28B – 2013]:

The Bill was debated by the House and passed. It has been sent to the President for assent.

National Environmental Management: Integrated Coastal Management Amendment Bill [B 8F – 2013]:

The Eastern Cape, Free State, Gauteng, Limpopo, Mpumalanga and Northern Cape voted in favour of the Bill, while the Western Cape voted against it. The Bill was sent to the President for assent.

Property Valuation Bill [B 54B – 2013]:

The Bill was debated by the House and passed. It has been sent to the President for assent.

National Credit Amendment Bill [B47B-2013]:

All nine provinces voted in favour of the Bill. It has been sent to the President for assent.

Division of Revenue Bill [B5-2014]:

All nine provinces voted in favour of the Bill. It has been sent to the President for assent.

Minerals and Petroleum Resources Development Bill [B15-2013]:

The Free State, Gauteng, Limpopo, Mpumalanga, Northern Cape and North West voted in favour of the Bill. It has been sent to the President for assent.
