Ms T Wana (ANC-EC) to ask the Minister of Justice and Correctional
Services:
Whether, with reference to media reports regarding labour-related matters
that include affirmative action and overtime payments in his department,
any plans are in place to resolve these matters; if not, why not; if so,
what are the relevant details? CO50E
REPLY
Yes, the Department and recognised Organised Labour are still in protracted
negotiations on the issue of overtime payments.
The idea is to attempt to resolve this matter amicably without including
courts. However, we acknowledge the delay as this matter is a very complex
matter, and is compounded by diverse views held by organised labour and the
Department respectively.
If no amicable solution can be found, the Department will propose a process
of mediation to be agreed upon.
With regard to affirmative action, the Departmental Employment Equity Plan
is clearly outlining the Departmental Affirmative Action Policy which is
progressing very well thus far. However, Solidarity took the Department to
court, alleging that the Affirmative Action is implemented unfairly and
itâs therefore discriminatory against Whites and Coloureds.
The matter is currently before the courts and therefore subjudice. However,
the Department will comply with the judgement and order of the Labour
Appeal Court.
