Hon House Chairperson, hon Yako's question comes in two parts, the first part relates to the legality in terms of the Competition Act of a manager of one company MiWay, also serving on the board of another company Santam, which operates in the same sector. The Competition Act prohibits collusion between companies in the same sector. I am advised though in this particular instance, the company concerned is a wholly-owned subsidiary of Santam. Our law, the Competition Act and its provisions on collusion do not apply to wholly- owned subsidiaries, based on what is known as a single economic entity doctrine and I refer the member to the provisions of section 5.4 of the act.
