Chairperson, section 25 of the Protection of Constitutional Democracy against Terrorist and Related Activities Act, Act 33 of 2004, provides for the President, by proclamation in the Government Gazette, to give notice of any entity or person identified by the United Nations Security Council who commits or attempts to commit any terrorist attack or facilitates a commission of a terrorist attack or related activities against whom a member state of the United Nations must take action in order to combat terrorism and related activities.
In addition, section 26 of the Act states that all proclamations proclaimed by the President in this regard must be tabled in Parliament for consideration and decision. Parliament can, thereafter, take any steps that may be necessary in this regard.
In practice, the list includes the name of all persons linked to the Taliban as well as Al Qaeda. Member states are encouraged to submit names for listing as soon as they have sufficient supporting evidence that these persons or entities are involved in or linked to terrorist activities.
Member states are required to provide detailed information in support of their proposed listings. This information is included in a narrative summary. The relevant persons must be notified of the listing and relevant information. These lists are periodically reviewed and updated for new information.
The Portfolio Committee on Police regularly, at least once a year, but ideally, twice a year, receives a briefing by the Department of Police on all these proclamations published in the Government Gazette to date.
In addition to these proclamations, the Department of Police provides the committee with the details of the activities of the named individuals or entities and includes information as to whether any of these individuals or entities are South African or have links to South Africa. I am proud to stand here today and say that none of the people on the list are currently either South African or linked to South Africa, which clearly indicates that even making up stories in the media about the South African government, led by the ANC, harbouring terrorists is an absolute untruth. I move for the adoption of this Report. [Applause.]
