Madam Deputy Speaker, hon members, the committee received a briefing from the SABC board on its inquiry regarding the conduct of board member Adv Cawekazi Mahlati on Tuesday 18 September 2012. The board had also passed two votes of no confidence in Adv Cawekazi Mahlati, with allegations of misconduct. The committee also afforded Adv Cawekazi Mahlati an opportunity to present her version of events. Furthermore, the committee sought legal opinion from the Parliamentary Legal Services on how best to deal with the matter. The committee was briefed by the parliamentary legal adviser on the above matter on 30 October 2012. Having deliberated on the legal opinion as provided by the legal adviser, and having established that there would be no further action, or no action which is going to be taken by the Presidency in terms of section 15(1)(a) of the Broadcasting Act 4 of 1999, regarding the informal enquiry, which was conducted by the SABC board, the committee, based on that, recommends that: Firstly, an inquiry is conducted, in terms of section 15(a) of the Act, by the committee; secondly, the committee be authorised to refer the matter to the Office of the Auditor-General for a special integrated audit; thirdly, the report of the Auditor-General be considered by the committee for recommendations to the House; and, finally, the National Assembly inform the appointing authority of the inquiry to be conducted in terms of section 15(a) of the Act.
