Hon Chairperson and hon members of this august House, the Promotion of Access to Information Bill arose from a Constitutional Court judgment in My Vote Counts NPC v Minister of Justice and Correctional Services, known as the my vote counts case, NVC case. On 21 June 2018, the Constitutional Court ordered that information on the private funding of political parties and independent candidates is essential for the effective exercise of the right to make political choices and to participate in the elections. The Promotion of Access to Information Act is invalid to the extent that it is inconsistent with the Constitution by failing to provide for the recordal, preservation and reasonable disclosure of information on the private funding of political parties and independent candidates. And Parliament must amend the Promotion of Access to Information Act and take any other measure it deems appropriate to provide for the recordal, preservation and facilitation of reasonable access to information on the private
