Business - Code of Conduct for EME / SMME'S related to Municipal ward base projects.

Dear Portfolio Committee on Small Business Development,

Good day.
I have a CIDB (level 1), SARS, CIPC registered and municipal compliant company. My company is still very small or rather emerging due to the fact that we don't get or rather being marginalised by all atmospheres related to job / wealth creation in South Africa.

As a EME / SMME in the Northern Areas of Gqeberha, I/We find it very difficult to manage or co-exist in harmony amongst ourselves and especially with contractors who comes into our Ward to do a municipal job / Project.

Many of these contractors is underhand, unscrupulous and quickly to exploit the daring situation in our ward. The ward Councillor is of no help or rather being limited into the actions / operations of the EME / SMME their ward or constituency.

We as "ward based" EME / SMME is and have been trying to find other amicable solution to our problems for the last 10 to 15 years but to no avail.


As a possible solution to our problems, we have created a structure called the the Exacative Committee within the Ward. The Exacative Committee (EXCO) or leadership consist out of the following who have been publicly elected under the umbrella of the Ward Councillor and it consists out of the following:

The Chairperson

The Deputy Chairperson

The Treasurer

The Secretary

The Deputy Secretary

The above elected have in most cases Absolutely No idea or the slites inclination of what he is supposed to do and how to forfull the function of his /her particular office.


The root of the problem is, there is no government regulationted code of conduct for the "Municipal Ward based" EME / SMME???

Since the President introduced the 30% allocation for the EME / SMME from clients/contractors, everything has gone heywire. The government has just introduced this policy without doing any research regarding the implementations of this policy onto the EME/SMME's.

Please if possible could you help or direct me to the ideal person, institution or department who can help me/us to formulate/draft a Code of Conduct in relation to our dilemma.


Note :

In the mists of all this rumble in the jungle, I have came up with some possible solution to some of our problems. In my possession I have a drafted document identifying certain points with possible solutions to them in relation to operating procedures of the municipal Ward based EME / SMME's and contractors.

I think this could be advantageous to the development of a Code of Conduct for municipal Ward based EME / SMME'S and Contractors.
