Hon Speaker, over the past few years there has been an increase in the number of pieces of legislation that are declared unconstitutional by the Constitutional Court. This occurred despite Parliament having spent millions of rands soliciting legal opinion and advice from the so-called constitutional law experts about the constitutionality of such pieces of legislation.
The UDM is concerned about this as it undermines the legislative role of Parliament as an institution that makes and passes laws for the Republic of South Africa. We call on Parliament to adopt some punitive measures against the culprits.
One of the things Parliament should actually consider is claiming back some of the fees paid to lawyers who gave it shoddy constitutional legal advice. Thank you.
