Meeting Summary

The Committee considered and adopted the Committee Report on matters referred by the Speaker and adopted one set of minutes. It further considered Mr Mgidlana’s Response to statements made by Mr F Shivambu (MP) in terms of Section 25 of the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Act, 2004, that Mr Mgidlana was “corrupt”. The members agreed unanimously that the response would be ATCd as well. It further agreed to write to Oakbay Investments to let the company know that its matter has been closed.

The Chairperson stated the purpose of the meeting was to confirm decisions taken in the previous meeting to be ATCd.

 

The Committee then accepted the agenda.

 

Adoption of Minutes

The Chairperson took the members through the document, page by page.

 

Mr S Esau (DA) proposed for the correcting of minor grammatical errors, which were accepted. 

 

Ms T Mantashe (ANC) moved for the adoption of the minutes.

 

Mr M Booi (ANC) seconded the motion.

 

The minutes were adopted with minor amendments.

 

Mr Mgidlana’s Letter to Parliament

 

The Committee then considered and reviewed Mr Mgidlana’s response to statements made by Mr F Shivambu. The Committee agreed unanimously to Mr Mgidlana’s response and indicated the response would be ATCd.

The Chairperson then asked the Parliamentary Legal Advisor about the status or developments regarding the Powers, Privileges and Immunities of Parliament and Provincial Legislatures Amendment Bill (B18-2018) in the NCOP.

 

Advocate Frank Jenkins, Senior Legal Advisor, Parliament, said the Bill was with the NCOP select committee processes, but he did not know how far the NCOP has gone with the processes.

 

Mr M Filtane (UDM), on the request by Oakbay Investments that it be allowed to reserve its position regarding any engagement with the Committee, suggested the Committee to write to Oakbay and tell them the matter has been closed.

 

Mr Esau said Mr Howa left the employ of Oakbay and the CEO stated they were reserving the right but not making a decision. So, the matter was closed.

 

Mr Booi proposed for the acceptance of the report.

 

Mr Filtane seconded the proposition.

 

The report was adopted with no amendments.

 

The meeting was adjourned.
