In this virtual meeting, the Committee considered and adopted two draft reports.

The first draft report was on the withdrawal of Interventions issued in terms of Section 139(1)(b) of the Constitution (1996) in Maluti-a Phofung and Mafube Local Municipalities.

The second draft report was on the Notice of Interventions in terms of sections 139(7) of the Constitution and 150 of the Local Government: Municipal Finance Management Act in Manguang Metro Municipality and Enoch Mgijima Local Municipality.

In respect of the second report, the Committee agreed that as soon as the administrators are appointed, it should request a report from the national department seeking more details on those administrators to verify their competence, skills, qualifications as well as their experience which made them qualified for the position.

Meeting report

The Chairperson greeted Members and guests in attendance and indicated that this meeting was the beginning of the third term.

The Chairperson indicated that he had received apologies from Minister Dlamini-Zuma, Deputy Minister Nkadimeng, and Deputy Minister Bapela.

The Chairperson expressed his gratitude for Members’ heartfelt condolences to him and his family. On behalf of the Select Committee, he also passed on condolences to Mr K Motsamai’s (EFF, Gauteng) family. The horrific incident that had happened to Mr Motsamai’s daughter was unacceptable.

The Chairperson then outlined the meeting agenda.

Draft report on the withdrawal of Interventions issued in Terms of Section 139(1)(b) of the Constitution (1996) in Maluti-a Phofung and Mafube Local Municipalities

Mr Moses Manele, Committee Secretary, read the Select Committee’s observation and recommendation sections of the draft report.

Ms L Kleynhans (DA, Free State Legislature) pointed out an error in the draft report and stated that Maluti-a Phofung Municipality was not under administration at the moment as she had had numerous written questions and replies with the national COGTA. She confirmed that Mafube Local Municipality was indeed under administration as a result of a court order.

Ms S Shaikh (ANC, Limpopo) confirmed Ms Kleynhans’ point. The Department had recommended the placement of Maluti-a Phofung under s139 administration but it had not happened as yet. She suggested the sentence be restructured to state that the Select Committee noted the Department’s recommendation on Maluti-a Phofung.

The Chairperson said that it was unacceptable that such a factual error should happen in the Committee’s draft report.

The report was adopted, with amendment, by all members.

Draft Report on the Notice of Interventions in Terms of Sections 139(7) of the Constitution and 150 of the Local Government: Municipal Finance Management Act in Manguang Metro Municipality and Enoch Mgijima Local Municipality

The Chairperson explained that s139(7) was implemented by the national COGTA and a s150 Municipal Finance Management Act (MFMA) intervention would be implemented as a result of s139(7).

Mr Manele read the Select Committee’s observation and recommendation sections of the draft report.

Mr I Sileku (DA, Western Cape) wanted to include a point to ensure that the appointed administrators are competent, and professional and are not aligned with any political factions. He noted that political instability especially in Mangaung Municipality is the cause of it being placed under administration. Hence, it is important that the Select Committee should have some form of mechanism to prevent that.

The Chairperson suggested that as soon as those administrators are appointed, the Select Committee should request a report from the national COGTA seeking more details on those administrators to verify their competence, skills, qualifications as well as their experience which made them qualified for the position.

Mr Sileku agreed with that suggestion.

The report was duly adopted.

The meeting was adjourned.
