SUMMARY
A few items on the Committee's agenda for the third term were highlighted. The Committee has received ninety-four responses to the advertisements placed regarding the MDDA board positions, and a final list of 33 nominees was decided upon by Members. The interviews will take place on 15, 16 and 19 to 21 August 2002, and the Committee report is expected to be table in Parliament in early September.

MINUTES

The Chair reported that Mr Smuts has resigned from the Independent Communications Authority of South Africa (ICASA) board, with the result that the Committee would have to decide on a replacement during this session. His resignation was a great loss to the regulator.

The most interesting item on the agenda for the third session is the meeting with the South African Broadcast Corporation (SABC) board on Tuesday 13th August. The chairperson of the board has informed the Committee that she will be engaged in a three month study leave period , and the acting-chairperson will be present at the meeting.

On 23 to 25 October 2002 an important gathering will be taking place in Johannesburg regarding "Tel.com Afrika", and it still has to be decided whether it would be necessary for this Committee to attend.

It would also be beneficial to conduct hearings towards the end of this year into the standard of service delivered by the cellular telecommunications service providers, and the views of relevant consumer organisations and cellular telephone users would also be heard. The aim would be to ascertain exactly "what's going on" because many complaints have been reported regarding poor service standards, such as experiences with dropped calls, the poor signal quality, confusion and inconsistencies with the itemised billing facility and the uncertainty with regard to the costs of dropped calls and the subsequent reconnection cost.

These are a few matters that have to be addressed during this session of Parliament, and the final version of the Committee programme will be made available in due course.

Media Development and Diversity Agency Board: Shortlisting of Directors
The Chair read Sections 4, 5 and 8 of the Media Development and Diversity Agency Act which deals with the constitution of the Media Development and Diversity Agency board (the board), the requirements for appointment to the board and the term of office of its directors.

A total of ninety-four responses have been received, and this overwhelming response from the South African public and the quality of the nominations inspires confidence in the work being done by Parliament. No less than 120 telephone calls have been received regarding the nominations to the board, not excluding the numerous faxes, e-mails and general correspondence received. This has resulted in a list of ninety-four names, but the reality of the matter is that they have to be reduced to only six.

The primary contributing factor to this overwhelming response has been the decision to advertise, for the first time, via community based radio stations, in an effort to broaden the spectrum and range of people reached by the advertisement. This could possibly be a lesson to be learnt in future, and community based radio could very well be the most effective means of advertising. In fact, print media exclusively has been used in the past to advertise such matters, and the current response even exceeds the response received regarding the recent filling of the posts of the ICASA councilors.

The Committee would have to decide on the length of each interview, the number of interviews to be scheduled for each day allocated as well as the process for conducting the interviews. Members have to be mindful of the fact that only three-and-a-half days have been set aside for this matter, and the interviews would commence on 15 August 2002, perhaps even as early as 14 August 2002.

Ms Smuts (DP) suggested that the shortlist be limited to no more than twenty names which is three times the final number, because this is the first time this board would be constituted and it would be preferable to be too inclusive than exclusive.

Mr R Pieterse (ANC) agreed with Ms Smuts as a greater number could result in additional time being allocated for the completion of this matter, and Members are not always able to attend Friday meetings.

Ms Smuts proposed that each interview be no longer than thirty minutes.

The Chair requested the parties to submit their list of candidates.

The Chair informed Members that he has been reported, unofficially, that nominee number 56, Mr T Rantho, has been killed in a motor vehicle accident over the weekend, and his name would thus have to be stricken from the list. Mr Rantho would be well known to Members via his interactions with this Committee, and he was most recently interviews by this Committee for the position as ICASA councillor.

Mr Pieterse referred to the statement made earlier by the Chair regarding the meeting with the SABC board and suggested that E-TV be invited to address Parliament as well, and that this be added to this Committee's agenda for this session. The ANC earmarks the following nominees for shortlisting:

The Chair noted that there are no less than 26 nominees shared by the two lists just proposed.

Ms Smuts suggested that each party drop all those nominees it has shortlisted but which they are not shared.

The Chair noted that the shortlist now stands at a total of 35 nominees.

Ms Smuts suggested that this amount be reduced further, as those Members arguing for the inclusion of thirty names will not be present throughout the interviewing of those thirty.

Mr Magashule stated that the following names should also be dropped form the list:

Ms Smuts requested Mr Magashule to consider striking the following from the list proposed by the ANC, as the current amount is unrealistic:

The Chair noted that a total of 26 nominees have now been arrived at, but contended that 31 could also be properly interviewed within the time allocated. The process will not only serve as an interview but also to allow people to air and discuss their views on media development and diversity. This is especially important in view of the fact that this is a new board which has not which has not been constituted before.

Ms Smuts stated that the DP would then have to rotate its members to ensure its presence at all the interviews.

The Chair reminded Members that this Committee conducted the interviews of the possible ICASA councilors for an entire week, and thus it would be able to interview 31 nominees in little over three days. The net has to be cast very wide here to ensure a diversity of views, expertise and experience is ensured. The shortlist does cover a very diverse range of nominees from the South African media industry, and the exclusion of too many nominees from that list could upset the balance. One cause for concern is the fact that the names of many more men than women are reflected in the list.

These names will now be released to the media for publication, and the interviews will take place on 15, 16, 19 to 22 August 2002, with the last two days allocated for finalisation of the final six nominees. It is hoped that the Committee Report would be tabled in Parliament in September, perhaps as early as the first plenary on 4 September 2002.

The Chair drew the Committee's attention to one final matter that has to be addressed regarding the interview process. His ex-wife has been shortlisted and is now one of the final 32 to be interviewewd by this Committee: number 61, Ms KJ Cullinan. He thus requests guidance from Members as to how he should proceed, as a conflict of interests could very well arise.

Ms Smuts thanked the Chair for informing Members of this development, and stated that the decision is left to the Chair's judgement as to whether he should recuse himself or not. The Chair could recuse himself for that particular interview and the finalisation process.

Mr M Lekgoro (ANC) stated that the ANC would announce its position on the matter before the commencement of the interview process.

The Chair stated that he would also consult the parliamentary office in this regard.

There were no further questions or comments and the meeting was adjourned.
