The Committee conducted interviews of candidates for the SABC board.

The Committee had shortlisted 24 candidates to be interviewed for the eight vacancies on the SABC board. In this meeting, only eight candidates of the shortlisted were interviewed. The interviewed candidates were; Ms Jasmina Patel, Adv. Mathews Mofokeng, Adv. Motshedi Benjamin Lekalakala, Mr Nkosana Mbokane, Ms Mamoduphi Mohlala-Molaudzi, Mr Siphile Buthelezi, Mr David Maimela and Mr Gift Buthelezi.

The Committee agreed not to consider the Films and Publication Amendment Bill as Parliament’s legal department still had to incorporate the amendments.

The Committee tested the candidates on a wide variety of issues including digital migration, political interference, ethics, governance, unfunded mandates, funding model and their understanding of various legislation. They were also asked what value and unique skills they would bring to the board, the SABC’s mandate and how they would fix the myriad of problems facing the public broadcaster and the board.

Meeting report

Opening remarks

The Chairperson greeted everyone and noted that the Committee was supposed to look at the Films and Publication Amendment Bill, but Parliament’s legal department was still incorporating the comments which were made. The Constitutional and Legal Services Office promised to avail someone to take the Committee through the Bill at some point over the next few days.

The Chairperson apologised for the delay. According to the programme, the first candidate should have appeared before the panel at 10 am. She also asked the Committee to give allowance to members who were called for another meeting.

The meeting was then adjourned for an hour and started at 11:30.

The Committee stated that each Committee member would be given only five minutes to engage with the candidate and if there is still time members were allowed to do follow-ups.

The Chairperson also brought to the attention of the Committee the letter which had been sent to her from COSATU (Congress of South African Trade Unions) and the Communication Workers Union (CWU). The letter stated that the shortlist drafted by the Portfolio Committee to fill the vacancies on the SABC board is in direct violation of the Broadcasting Act. The Act requires the inclusion of labour on the SABC board. According to the shortlist provided, no person from the labour has been shortlisted for consideration on the board. The shortlist is therefore in direct violation of the Broadcasting Act. The letter further read that for several years, Parliament has failed to ensure that labour is represented on the board. This is despite COSATU and the CWU making nominations of qualified candidates. COSATU and CWU were, therefore, calling upon the Committee and Parliament to halt this process until the matter has been rectified. This was non-negotiable and failure to rectify the matter will compel COSATU and CWU to approach the courts for a legal interdict to halt the parliamentary processes until the Parliament is in compliance with the Act.

The Chairperson stated that the Committee was not going to engage with the issue for now because procedurally this has to be referred to the legal department.

Mr M Ndlozi (EFF) asked the Chairperson if she could send the letter to the members because it looked like they were misquoting the law

The Chairperson responded that the letter was going to be channeled through parliamentary processes and it would be sent to Members as well as the legal department. 

The Chairperson asked members if the Committee could proceed with the interviews.

The members agreed to proceed with the process.

 Candidate 1: Ms Jasmina Patel 

The Chairperson apologized to Ms Patel for the delay. She asked Ms Patel to give Members a summary of her qualifications, experience and whatever she thinks the panel must know which has brought her to the point of being shortlisted.

Noting the current financial situation at the SABC, Ms Van Damme P (DA) asked Ms Patel what creative solutions would she bring to the board with regards to its funding model and its finances.

Mr Xaba N (ANC) asked Ms Patel if she has a TV license and if she is paying for it.

Mr Xaba asked about Ms Patel’s understanding of the Companies Act with in relation to the Broadcasting Act and SABC and where they meet.

Mr Xaba asked the candidate what he thinks of the three tier system of public, commercial and community broadcasting services at the SABC.

Mr Xaba asked how she would contribute to the issue of digital migration for it to be speedily implemented.

Mr Xaba also noted that SABC has a history of bankruptcy. He asked Ms Patel how it can be resolved.

Ms W Newhoudt-Druchen (ANC) noted that there have been instances of labour unrest in various institutions including the SABC. How can such a matter be dealt with in the absence of a labour expert on the board? What would she do to remedy the situation?

Ms Newhoudt-Druchen asked the candidate her view of the Broadcasting Amendment Act. Did she know what it is about and how it affects the board members and the SABC?

Mr R Tseli (ANC) asked Ms Patel what she understood was the role of SABC in the upcoming elections.

Mr Tseli asked the candidate what skills she will bring if appointed board member to deal with the challenges that currently confront the SABC.

Mr Tseli noted that there are suggestions that the role of the executive directors (CEO, COO and CFO) should be reviewed. He asked Ms Patel what her take on that is.

Mr Ndlozi asked Ms Patel what her favourite programme on SABC is excluding the news.

Mr Ndlozi asked what her view is with regards to the 90% rule in relation to its financial implications.

Mr Ndlozi asked if she knew why the SABC cut the Bold and Beautiful.

Mr Ndlozi noted that SABC has established Free to Air (FTA) services because of the push against the commercialisation of information. The OTTs (Over The Top media services) like Netflix have a problem for instance in relation to data cost. The majority of rich people no longer watch the SABC anymore, they watch OTT and even Multichoice is suffering. Given this, how would she reconcile the two; the fact that SABC has this public broadcasting responsibility to make sure that it is accessible to the poor at no cost or very low cost and the fact that it has so many financial problems.

Mr Ndlozi noted that many people do not stay on for long on this board. He asked what she thought was the problem.

Mr Ndlozi asked her what she is going to do to protect her reputation if she is appointed as a board member

Mr Ndlozi noted she had said she does not watch SABC and asked if it would it be fair on South Africa to appoint someone who does not watch the public broadcaster.

Ms P Van Damme (DA) noted that the SABC is a highly contested political space which needs people with a strong backbone. It is a space that needs a person who does not quickly quit. Ms Van Damme noted that Ms Patel had not presented herself as someone who is firm. She asked Ms Patel to convince her that she is firm and not a quitter. She asked her if she is in it for the long run and willing to see it through.

Mr Xaba asked how she would encourage people to pay their TV license.

Mr M Kalako (ANC) noted that there have been talks about reviewing the role of the executive on the board of the SABC. He asked her what her take is on the issue

The Chairperson asked Ms Patel if there was anything else she would like to add or want the Committee to know about.

Candidate 2: Adv Mathews Mofokeng

The Chairperson asked Adv Mofokeng to give Members a summary of his qualifications, experience and whatever he thinks the panel must know which has brought him to the point of being shortlisted.

Ms Van Damme asked what he wants to do on the SABC and what he would bring to the public broadcaster. What sets him apart from all the people who have legal experience?

Ms Van Damme noted that in his CV he mentions that his computer literacy is semi-literate. How then does he deal with things such as emails?

Ms Van Damme noted Adv Mofokeng had mentioned that he worked in the Office of the Premier in the Free State. What was his role in that office?

Ms Van Damme noted that his CV states that he worked in the Premier’s office in the Free State. She further noted that he does not have any broadcasting experience and he did not say what he is would bring to the SABC board. She, therefore, asked the candidate to please explain what he did in the Premier’s office.

Ms M Matshoba M (ANC) noted that there are more than 2 million non-South Africans with different cultures who are living in South Africa. She asked what he thinks the role of SABC’s role is in promoting cultural diversity and making sure that its coverage goes beyond South African borders.

Ms Matshoba asked how the SABC can contribute to the transformation of young people especially women.

Ms Van Dyk (DA) noted that in his CV the candidate mentions that he is a council member of Flavius Mareka TVET College since 2017 but this does not reflect on the website, why?

Ms Van Dyk asked Adv. Mofokeng if he was a counselor.

Ms van Dyk referred to the governance of the SABC and asked the candidate what his understanding of the Broadcasting Act is.

Ms Van Dyk asked Adv Mofokeng what he thinks about the SABC funding model and if it can be improved and if so how.

Mr Xaba N (ANC) asked Adv Mofokeng if he has a TV license and if so, is he paying for it?

Mr Xaba asked the candidate what can be done to make people pay their TV licenses.

Mr Xaba asked the candidate what he thinks is the role of SABC as an entity.

Mr Tseli R (ANC) asked the candidate why previous boards normally disintegrate within a short space of time and what he thinks can be done to avoid this.

Mr Tseli asked Adv Mofokeng what he understands is the role of SABC in the upcoming elections.

Mr Tseli noted that there are those suggesting that the executive should be dissolved. He asked Adv Mofokeng what his take was on this issue

Mr Ndlozi M asked how the OTTs (Over the top programmes) affect the trajectory of Television particularly the free to air model and how the SABC should deal with that.

Mr Ndlozi asked the candidate in what way DTT (Digital Terrestrial Television) would help address the phenomenon of OTTs (Over the top programs).

Ms Van Damme noted Adv Mofokeng kept on saying that he is a man with a plan. She asked him to state in one sentence what innovative solutions he would bring to SABC.

Ms Newhoudt-Druchensaid  that seeing the SABC has a public service mandate as well as a commercial mandate; how would he ensure that there is a balance between the two without one being compromised.  

Ms Newhoudt-Druchen highlighted that the Broadcasting Act stipulates that programmes should be made available to all South Africans through all the official languages. However, there is also sign language and the language of the Khoi people, which, while not official, should be considered. How would he ensure that those minority groups are also catered for and ensure that they are satisfied?

The Chairperson asked Adv. Mofokeng if they are any questions he would have loved to discuss which were not asked by the members.

The Chairperson asked the candidate if there was anything else that needed to be brought to the Committee’s attention.

Candidate 3: Adv. Benjamin Lekalakala

The Chairperson asked Adv. Benjamin Lekalakala to give members a summary of his qualifications, experience and whatever he thinks the panel must know which has brought him to the point of being shortlisted.

Mr Kalako asked Adv Lekalakala what problems affected previous boards that were appointed and then suffered resignations or had to be dissolved shortly thereafter.

Mr Kalako asked the candidate about the role played by the SABC Executive team versus the board.

Mr Kalako noted that there are acts that govern the SABC and how it operates, which includes the Companies Act and the Broadcasting Act. He asked the candidate which one is the principal Act (which one supersedes the other) when dealing with problems at the SABC?

Mr Kalako noted that there is an issue of political interference by Ministers which then takes away the independence of SABC. He asked Adv. Lekalakala to explain his understanding of independence.

Mr Kalako asked him that if he is a member of the board and one of the political parties, whether it is EFF, ANC or UDM, starts to interfere with the newsroom, by trying to influence the directors or some of the board members:

1.     How would he deal with that in relation to parties?

2.     How would he deal with that in relation to a board member which goes to the newsroom and try to influence that newsroom for a particular party?

Mr Xaba asked Adv Lekalakala if he has a TV license; and if so, does he pay the license fee.

Mr Xaba asked what can be done to make people pay their TV licenses.

Mr Xaba asked the candidate what he can do to resolve the bankruptcy that is affecting the SABC.

Mr Xaba asked how he will contribute to the speedy implementation of Digital migration

Ms Van Damme referred to the candidate’s CV and noted he was a secretary of a Municipal Council between 2013 and 2017. She further noted that he had approved the budget and strategic programmes of the council as well as advised the council on all administrative and legislative matters. However, the current administration in the city of Johannesburg has investigated a total of 4000 cases of corruption and fraud amounting to R24 billion. During the candidate’s tenure, there was a contract of R6 million for 500 computers which were never delivered but the money was paid. 19% of the budget was stolen through corruption. Given his role as the person who approved the budget for the council and gave administrative and legal advice to the council, she asked the candidate to explain all the corruption that has been uncovered.

Ms Van Damme asked how the candidate how he performed his role in an environment where there was rampant corruption.

Mr Ndlozi noted that, in Ekurhuleni, Adv Lekalakala had the responsibility to advise the council in relation to Mr Joe Mojapelo on his appointment back into council. He asked the candidate if he agreed that it was his role to advise the speaker of the disciplinary proceedings against Mr Mojapelo.

Ms Newhoudt-Druchen asked Adv Lekalakala what value he would bring to the SABC.

Mr Tseli noted that there have been talks about reviewing the rule of the executive on the board of SABC. He asked him what his take is on the issue.

Mr Tseli noted that the SABC board has on a number of occasions said to the Parliament that part of the reasons they find themselves in financial difficulties is the issue of unfunded mandates. He asked the candidate if appointed, what would he contribute to the board to ensure that they deal with this particular challenge.

Mr Tseli also asked Adv Lekalakala what he believes is the role of SABC in the upcoming elections.

The Chairperson asked the candidate if there was anything else that needed to be brought to the Committee’s attention.

Candidate 4: Mr Nkosana Mbokane

The Chairperson asked the candidate to give members a summary of his qualifications, experience and whatever he thinks the panel must know which has brought him to the point of being shortlisted

Ms Van Damme asked Mr Mbokane about his thoughts on political interference at the SABC.

Ms Van Damme asked the candidate, knowing that the Committee is looking for people who can stand against political interference, why would he put ministers or politicians as his references.

Ms Van Damme noted that in 2016 Mr Mbokane wrote an article named “Black decision makers in the SOEs under attack, who would be on their side”. This article included the likes of Brian Molefe, Tom Moyane, Gengezi Mgidlana, Siyabonga Gama, Dudu Myeni, and even Hlaudi Motsoeneng.  She noted that in 2016, the candidate thought Mr Moetsoneng was a good person and was just a poor black person being targeted and yet he was involved in the corruption allegations. She asked him why he now wants to serve under the SABC board and yet Mr Moetsoneng whom he supported is responsible for the mess that SABC is facing now.

Mr Xaba asked Mr Mbokane if he has a TV license; if so, is he paying the license fee?

Mr Xaba asked the candidate what he can do to resolve the bankruptcy that is affecting the SABC.

Mr Xaba asked how he will contribute to the speedy implementation of Digital migration

Mr Xaba asked Mr Mbokane to explain how the Companies Act interlinked with the Broadcasting Act.

Mr Tseli noted that there has been a history of SABC boards dissolving quickly after being appointed. He asked Mr Mbokane what he would do differently to prevent the board from being dissolved.

Mr Tseli noted that there have been talks about reviewing the role of the executive sitting on the board of the SABC. He asked him what his take is on the issue

Mr Tseli noted that the SABC board has on a number of occasions said to the Parliament that part of the reasons they find themselves in financial difficulties is the issue of unfunded mandates. If appointed, what would he contribute to the board to ensure that they deal with this particular challenge?

Mr Tseli asked Mr Mbokane what he believes is the role of SABC in the upcoming elections

Ms Van Dyk said that she had looked at the social profile of Mr Mbokane and had seen that he is a strong supporter of the ANC. She asked him to convince the panel and the public that his party affiliation would not affect his decision making if appointed a member of the board

The Chairperson also asked him if there is anything that he thinks once he is appointed somebody out there could bring to the fall of parliament which has not been picked anywhere.

The Chairperson asked the candidate if there was anything else that needed to be brought to the Committee’s attention.

Candidate 5: Ms Mamoduphi Mohlala-Molaudzi

The Chairperson asked the candidate to give Members a summary of her qualifications, experience and whatever she thinks the panel must know which has brought her to the point of being shortlisted.

Ms Van Damme said to Ms Mohlala-Molaudzi that there is a perception that she is a trouble maker. At the Department of Communications, she had a fall out with Minister Siphiwe Nyanda which resulted in President Zuma stepping in. Also when she moved to the National Consumer Commission, she also had a fall out with another Minister. In light of this, she asked if the candidate is a difficult person to work with or was it something else. She added that the reason for asking is because the SABC needs people who are team players and stick together when the going gets tough.  Was she a team player and what is her side of the story with regards to these ministers?

Ms Van Damme also noted that there was a time when Ms Mohlala-Molaudzi was in full support of a 1% tax for all South Africans to fund the SABC. The SABC board and the Minister of finance were against it. She asked if she still believes that South Africans should be charged 1% of their tax to fund the SABC.

Mas Van Damme also noted that there was a report of an incident between Ms Mohlala-Molaudzi and her domestic worker were she is said to have alleged that her domestic worker stole from her. This resulted in a physical altercation and Ms Mohlala-Molaudzi’s husband is said to have slapped the domestic worker. He is also alleged to have tried to pay her off so that she could drop charges against him. Ms Van Damme asked her response to that.

Ms Newhoudt-Druchen asked the candidate about her views of the Broadcasting Act.

Mr Tseli noted that the SABC is accountable to the shareholders but most often when the shareholder intervenes it is accused of interference. He then asked her, if appointed as a board member, how best she would ensure that these criticisms that are always levelled towards the shareholder are minimised.

Mr Kalako asked Ms Mohlala-Molaudzi what makes the SABC board disintegrate within a short time.

Ms Matshoba asked her what unique expertise she will bring to the SABC.

Ms Matshoba asked Ms Mohlala-Molaudzi if she supported retrenchments at SABC and what can be done to avoid this.

Candidate 6: Mr Siphile Buthelezi

The Chairperson asked the candidate to give members a summary of his qualifications, experience and whatever he thinks the panel must know which has brought him to the point of being shortlisted.

Mr Xaba asked the candidate if he has a TV license; and if so, does he pay the license fee.

Mr Xaba asked what can be done to make people pay their TV licenses.

Mr Xaba asked the candidate what he can do to resolve the bankruptcy that is affecting the SABC.

Mr Xaba asked how he will contribute to the speedy implementation of Digital migration.

Mr Xaba asked the candidate to give her view on Ministers providing leadership at the SABC.

Ms Newhoudt-Druchen asked Mr Buthelezi to indicate his understanding of the Companies Act and the Broadcasting Act.

Ms Newhoudt-Druchen noted that Mr Buthelezi had mentioned his involvement with Private companies and radio. She asked him to explain if whether there will be any conflict of interest if he is appointed as a board member

Ms Newhoudt-Druchen noted that the candidate was an MD at Buthelezi Vilakazi Inc. She also noted that he is currently on three different boards and a Chairperson. She asked him if it will not be too much to handle or was he going to relinquish some of his positions in the case that he is appointed as a board member.

Ms Van Damme noted that the candidate had served on the SAA Board under Dudu Myeni and asked how he would rate his performance as a board member.

Ms Van Damme asked that when there were bad decisions made at SAA, which they were, what was his position, did he raise his voice of objection?

Ms Van Damme asked Mr Buthelezi if there was anything else he would like to disclose about a contract that happened at SAA involving him

Ms Van Damme asked Mr Buthelezi to explain the accusations against him of soliciting a bribe.

Ms Van Damme asked if the candidate is actively campaigning for the ANC and how would he conduct himself if appointed a board member.

Ms Matshoba what skills would he bring to the SABC.

Mr Ndlozi asked him that since he was at SAA during the time Dudu Myeni, what did he do to fight the distraction she did on SAA

Mr Ndlozi asked the candidate if he challenged Ms Dudu Myeni.

Mr Ndlozi noted Mr Buthelezi is a strong supporter of ANC and asked if it would be fair to appoint someone who is actively campaigning for the ANC on social media to the SABC board; since there is a problem with Political interference

Mr Ndlozi asked Mr Buthelezi to distinguish between Companies Act and the Broadcasting Act in relation to the SABC.

Mr Ndlozi noted that Mr Buthelezi had said that Mzansi Magic is better than SABC. He asked him in what ways Mzansi Magic is better than the SABC.

With regards to the competition brought by OTTs (Over the Top programmes), Mr Ndlozi asked Mr Buthelezi what he thinks should be the response of SABC.

Candidate 7: Mr David Maimela

The Chairperson asked the candidate to give members a summary of his qualifications, experience and whatever he thinks the panel must know which has brought him to the point of being shortlisted.

Mr Tseli noted that the SABC is accountable to the shareholders but most often when the shareholder intervenes it is accused of interference. He then asked how the candidate would ensure that these criticisms that are always leveled towards the shareholder are minimized.

Mr Tseli noted that the SABC board has on a number of occasions said to the Parliament that part of the reasons they find themselves in financial difficulties is the issue of unfunded mandates. He asked him that if appointed; what would he contribute to the board to ensure that they deal with this particular challenge

Ms Van Damme said to Mr Maimela that he does not have the qualifications or experience to serve on the board. She asked him to convince the Committee why he should be on the board given that there are actually people who have the experience

Ms Van Damme asked the candidate if his political affiliation with ANC will affect his decisions making if he is appointed as a member of the board.

Ms Van Damme asked him how editorial decisions are made at the SABC and by whom.

Mr Xaba asked the candidate if she has a TV license; and if so, does he pay the license fee.

Mr Xaba asked what can be done to make people pay their TV licenses.

Mr Xaba asked the candidate what he can do to resolve the bankruptcy that is affecting the SABC.

Mr Xaba asked how he will contribute to the speedy implementation of Digital migration.

Mr Ndlozi asked him if it will be fair to appoint someone who is actively campaigning for ANC as this would create a question of bias.

Mr Ndlozi asked the candidate what his view is on the proposed Media Appeals Tribunal (MAT).

Mr Kalako asked Mr Maimela if in his view the programmes carried by SABC are effective in educating the people and if they encompass cultural diversity, race, and tribal diversity.

Mr Kalako asked him what the fundamental principles of the Broadcasting Act are.

The Chairperson asked the candidate if there was anything else that needed to be brought to the Committee’s attention.

Candidate 8: Mr Gift Buthelezi

The Chairperson asked the candidate to give members a summary of his qualifications, experience and whatever he thinks the panel must know which has brought him to the point of being shortlisted.

Ms Matshoba noted that the SABC has lost its market share which has been taken over by the likes of the BBC. She asked the candidate what should be done for SABC to return its position.

Ms Matshoba asked Mr Buthelezi what he thinks is the reason for people not paying their TV licenses and what can be done for people to pay.

Ms Matshoba asked the candidate about the relationship between content and the payment of taxes are.

Ms Matshoba asked Mr Buthelezi who the Minister and Deputy Minister responsible for the SABC are

Ms Matshoba asked the candidate if supports the retrenchment of staff at the SABC.

Ms Matshoba asked the candidate what unique expertise he will bring to the SABC.

Ms Van Damme asked Mr Buthelezi to speak about his term at the Department of Telecommunications.  

Ms Van Damme said Buthelezi was charged and found guilty of failure to carry out lawful and reasonable instructions and mismanaging of finances of the state. Additionally, he lost his arbitration at the GCIS and is now challenging it in the labour court which means he has lost the case twice. Further, there was testimony by Phumla Williams at the Zondo Commission. Ms Williams had reported that the day Mr Buthelezi came to GCIS he came with Minister Faith Muthambi and the Minister asked Phumla Williams to give him an office. Ms Van Damme then asked Mr Buthelezi why he would accept being given office at the GCIS knowing very well that the job position was not advertised.

Mr Xaba asked how the relationship between the SABC Board and the Minister can be improved.

Mr Tseli noted that there have been talks about reviewing the role of the executive on the board of SABC. He asked what his take is on the issue

Mr Ndlozi M asked Mr Buthelezi if he had said he negotiated the broadcasting rights for FIFA and if it was legally proper

Mr Ndlozi asked where these rights were negotiated.

Mr Ndlozi asked who the group CEO at the time was.

Mr Ndlozi noted that SABC has been entering, with the influence of government, in wrong and quite bankrupting policies to ensure the dominance of Multichoice. He asked him if he thinks these policies were right.

Ms Newhoudt-Druchen asked Mr Buthelezi if he believed that the SABC is a public broadcaster; if he agrees what would he advise as a board member if appointed

Ms Newhoudt-Druchen asked that in terms of the switching of from analogue to digital, what would he propose to be done to speed up the process

The Chairperson asked the candidate if there was anything else that needed to be brought to the Committee’s attention.
